Borough of Chatham Municipal Court, State v. Boguslavsky,
March 20, 2007.
THE COURT: So you say the other car was going at a high speed up Watching …. How fast would you say it was going up Watchung Avenue?
[DEFENDANT]: Your Honor, high speed -- it -- it was probably going 30 I would say. THE COURT: How much? [DEFENDANT]: Thirty miles. THE COURT: Fifty miles an hour? [DEFENDANT]: Thirty. Thirty. Three-oh. … THE COURT: All right. I just wanted to be sure how fast the other car was going up the street. [DEFENDANT]: No more than 30, but -- THE COURT: All right. Fifty (sic) miles an hour. … COURT DECISION: [Defendant] says that the other car was behind him traveling at 50 miles an hour. It may be a small thing, but that's what he tells me, that the other car was going 50 miles an hour up this street. It's not true. It couldn't have happened that way. And because that didn't happen that way, I don't believe him on the other things he tells me that -- that happened here.Transcript 40:8-9, 40:11-18, 41:7-10, 78:8-9, 79:13-25, 80:1.
